A legal document called a "Durable Power of Attorney for Property Management" is an essential part of a good estate plan that also includes a Living Trust. The trustee of your Living Trust is responsible for managing the assets held in your Trust. Hoewver, if you should become disabled and unable to manage your assets that are not in your Living Trust, then the Durable Power of Attorney for Property Management" can help get those assets transferred into your Living Trust. Most "Durable Power of Attorney for Property Management" instruments have a "springing power" that means they only give the management power to the appointed Attorney-in-Fact when you become disabled and unable to make financial decisions on your own behalf. The power and authority of your Attorney-in-Fact ceases at your death.
